The Plaintiff was working in his place of work and there were works taking place beside the area where the Plaintiff was working. The Plaintiff stepped backwards into a hole in the ground which had been created by the works and suffered a very serious injury to his ankle. The Plaintiff sued his employers for failing to provide a safe place of work and allowing a hole to develop in the ground. He also sued the company who were carrying out works at the workplace for allowing the hole in the ground to develop, for not warning the Plaintiff about the hole and for not erecting a warning sign. The Plaintiff in this case had a pre-existing condition with his ankle, but this had not caused him a problem prior to the accident. Following this accident the Plaintiff suffered very serious pain in his ankle and it was accepted by the doctors that this would remain going forward.
