Accidents at Work *

If you have been involved in an accident at work due to no fault of your own then you may be entitled to make a work accident compensation claim*.  An accident at work claim falls under the personal injury jurisdiction of law*.

Accidents at work today are all too common, yet the accident claims Ireland statistics remain significantly low.

There are a number of laws under which the employees’ rights are protected in the work place.  Irish Health and Safety law states that ‘all workers are entitled to a safe place to work and a safe system of work’.  If you have had an accident and have suffered a personal injury or losses*, as a result of a breach of these laws, by someone else, then you may be entitled to personal injuries compensation*.

When making a work accident compensation claim* it is important to have sufficient evidence.

One should always report a work accident to one’s employer, manager or supervisor – this should always be recorded in an accident report book and signed by both you and the present party.  An initial report statement may later be used in court as evidence.

If you have suffered significant injuries at work, you should attend the hospital at once for medical treatment. In doing so you will not only be treated for your injuries but there will be a record of your accident on file.   Even if your injuries do not require a visit to the emergency room, it is still best to make an appointment with your doctor.

Regardless of whether you intend to make an accident at work compensation claim* or not, it is always advisable to seek medical attention. By attending your local GP or medical centre, a record of your injuries and the cause is recorded. Should those injuries subsequently worsen and become more serious, then you can return to you doctor and request a medical report, for your claim.

Always remember if you have been involved in an accident at work – there is no obligation on your employer to pay you in your absence.  ‘Sick pay’ is commonly misunderstood as something that an employer must pay, should harm come to an employee whilst at work.  If you have been involved in an accident at work your only entitlement is a social welfare payment – which you must apply for.
