THE JUDGMENT IS ENFORCED BY ANY COMBINATION OF THE FOLLOWING DEPENDING ON THE PARTICULAR CIRCUMSTANCES:
1. Registering the Judgment in the Registry of Judgments. The Judgment will subsequently be published in the relevant trade gazettes and therefore will adversely affect the debtor’s credit rating.
2. Lodging the Judgment with the local Sheriff’s Office who will seek to force payment of the judgment possibly by seizing the goods the debtor
3. Registering a Judgment Mortgage on the debtor’s lands/asset. If the debtor wishes to sell the property, the debtor must discharge the judgment mortgage in advance of such sale.
4. Applying to court for an Installment Order.
5. Issuing Bankruptcy Proceedings against an Individual
6. Petitioning the High Court for the purposes of appointing a Liquidator to a Company
7. An application can be made to Court seeking a Garnishee Order against a third party who holds money which is owed to the debtor.
WHAT COSTS CAN BE RECOVERED AGAINST THE DEBTOR IS JUDGMENT IS SUCCESSFULLY OBTAINED?
In uncontested cases, the courts will award costs against the debtor, which are very low.
In a contested case, it is up to the Trial Judge to decide whether to award costs. As a general rule costs will be awarded if you successfully obtain judgment.
How much will going to court cost me?
The costs of going to Court range widely depending on the size of the debt involved, andwhether the proceedings are contested or uncontested. Deciding to institute proceedings requires a consideration of many factors, including the size of the debt, prospects of success and whether a debtor has any money to pay.
Clients who are successful in a full hearing of a contested case will usually have their legal costs ordered to be paid by the debtor. The Court orders costs paid according to a scale of costs in most instances, and that scale falls below the amounts charged by solicitors on a time basis with clients. Every situation is different and requires specific advice as to likely costs.
